A trademark application protects a mark for the goods or services described in selected Nice classes. Class selection should follow what the business actually sells or plans to offer—not simply a similar brand’s filing.

Understand goods and service classes

The Nice Classification separates goods into classes 1–34 and services into classes 35–45. One business may need more than one class when its commercial activities span different categories.

Describe the commercial scope

The description within a class matters. It should accurately cover the goods or services for which protection is sought without being broader or narrower than the real business need.

Search before filing

A preliminary search can reveal identical or similar marks and help assess obvious conflicts. Search results need context because similarity, class and the nature of goods or services all affect risk.

Choose the correct filing basis

Applications may be filed on a proposed-to-be-used basis or with a claim of prior use. When prior use is claimed, supporting evidence and a user affidavit may be required.
